Artificial Intelligence Bill of Rights (SB 482) including data protection regulation was introduced to Florida Senate

On 22 December 2025, the Artificial Intelligence Bill of Rights (SB 482), including data protection regulation, was introduced to the Florida Senate. The Bill would regulate the sale and disclosure of personal information by artificial intelligence technology companies. It would prohibit the sale or disclosure of personal information unless the information is deidentified data. Artificial intelligence technology companies would be required to ensure that deidentified data cannot be associated with an individual, to maintain and use the data only in deidentified form, and to prohibit reidentification except for testing deidentification processes. Contractual obligations would apply to recipients of deidentified data, alongside business processes to prevent inadvertent release. Violations would be treated as deceptive or unfair trade practices enforceable solely by the Department of Legal Affairs of the State of Florida, with civil penalties of up to USD 50'000 per violation. The Bill would establish statutory rights of Floridians relating to the use of artificial intelligence. These rights would include supervision, access, limitation, and control of minor children’s use of artificial intelligence. The Bill would also provide the right to know whether a person is communicating with a human being or an artificial intelligence system, program, or chatbot. Further rights would include knowledge of whether artificial intelligence technology companies collect personal information or biometric data, and an expectation of protection and deidentification of such data. Additional rights would cover transparency for political advertisements created using artificial intelligence and civil remedies for defamation or unauthorised commercial use of name, image, or likeness involving artificial intelligence. Entry into force is set for 1 July 2026.
