Competition Authority imposed EUR 98.6 million fine against Apple over abuse of dominant position in app market

On 16 December 2025, the Italian Competition Authority (AGCM) imposed an EUR 98.6 million fine against Apple in its investigation into the company’s App Tracking Transparency (ATT) policy, focusing on its potential anti-competitive effects. The AGCM found that, because the ATT's privacy requirements fell short of obligations from privacy legislation, third-party app developers were required to issue a second consent request to ensure compliance. The AGCM found that Apple's infringement consisted of this requirement for a double consent request, since it was imposed unilaterally, detrimental to the interests of Apple's commercial partners, and disproportionate to achieving legitimate interests pursued by Apple. The AGCM further found that the requirement was excessively burdensome and could have been achieved by less restrictive means, which constituted an exploitative abuse given Apple's complete dominance in the market.
