European Commission proposed Regulation extending Interim Regulation's derogation from ePrivacy Directive until 2028 (2025/0429)

On 19 December 2025, the European Commission proposed a Regulation (2025/0429) to extend the applicability of the Interim Regulation's (Regulation (EU) 2021/1232) derogation from the ePrivacy Directive to support the detection of child sexual abuse until 3 April 2028. The derogation permits online service providers to voluntarily use technologies to process data to the extent necessary to detect, report, and remove online child sexual abuse material. The Interim Regulation was initially set to expire on 3 August 2024, though this was extended to 3 April 2026 by Regulation (EU) 2024/1307.
