United States of America: President signed Executive Order on establishing the National Policy Framework for Artificial Intelligence

On 11 December 2025, the President signed an Executive Order aimed at establishing a national policy framework for artificial intelligence (AI) aimed at removing barriers to innovation. The order states that the Administration should work with Congress to establish a single national AI standard that avoids conflicting State rules. This standard would override any State laws that contradict the policy and would include protections for children, respect for copyrights, prevention of censorship, and measures to keep communities safe. Until such a framework is created, the Administration considers it necessary to intervene when State laws are viewed as overly restrictive and potentially harmful to innovation. The order specifies that the policy on the national AI framework should have minimal regulatory burden. The order directs the Attorney General to establish an AI Litigation Task Force responsible for challenging State AI laws inconsistent with federal policy. It also requires the Secretary of Commerce to evaluate existing State AI laws, identifying those that conflict with the national policy, and to specify conditions for States’ eligibility for Broadband Equity Access and Deployment (BEAD) Program funding based on their AI laws. Furthermore, the executive order mandates the Federal Communications Commission (FCC) to initiate a proceeding on a federal reporting and disclosure standard for AI models, and the Federal Trade Commission (FTC) to issue a policy statement on the preemption of State laws that mandate deceptive conduct in AI models.
