Algorithm Accountability Act (SB 3193) was introduced to Senate

On 18 November 2025, the Algorithm Accountability Act (SB 3193) was introduced to the Senate, proposing to amend section 230 of the Communications Act of 1934 to limit liability protection for certain social media platforms. The Act would require a provider of a social media platform to exercise reasonable care in the design, training, testing, deployment, operation, and maintenance of a recommendation-based algorithm to prevent bodily injury or death that is reasonably foreseeable and attributable to the design characteristics or performance of the recommendation-based algorithm. The Act defines recommendation-based algorithms and social media platforms, including exclusions for platforms with fewer than 1 million registered users and specified services such as email programmes, online messaging services, private platforms, and platforms whose primary purpose is product reviews, internet commerce, music streaming, audiobook streaming, podcast streaming, news, or sports coverage. The Act includes exceptions for chronological or reverse-chronological sorting and for user-initiated searches, establishes enforcement through loss of section 230(c)(1) liability protection and a private right of action for compensatory and punitive damages, prohibits predispute arbitration agreements and predispute joint-action waivers, and specifies First Amendment protections. The Act also includes technical and conforming amendments to the Trademark Act of 1946, title 18 of the United States Code, the Webb-Kenyon Act, and title 31 of the United States Code.
