Coimisiún na Meán opened investigation into X over alleged non-compliance with Article 20 of the EU Digital Services Act

On 12 November 2025, the Coimisiún na Meán (Media Commission) opened a formal investigation into the provider of the X online platform (X) under the EU Digital Services Act (DSA) to assess possible contravention of Article 20, based on concerns from its Platform Supervision Team supported by information from HateAid and a user complaint. The investigation will examine whether people can appeal X’s decisions not to remove content reported for potential breach of terms of service, whether people are informed of report outcomes and their right to appeal, and whether X's internal complaints-handling mechanism is easy to access and user-friendly, with Article 20 requiring access to an effective internal complaint-handling system. The Commission stated that there is reason to suspect non-compliance with Article 20, in particular Article 20(1) and Article 20(3), outlined its role as Ireland’s Digital Services Coordinator, and pointed out that the investigation will be conducted under Part 8B of the Broadcasting Act 2009, as amended, with possible administrative financial sanctions of up to 6% of turnover subject to Circuit Court or High Court confirmation, and the possibility of a binding Commitment Agreement during the investigation.
