On 16 October 2025, the Bill to establish special legal action to protect individuals’ image rights against unauthorised content generated by artificial intelligence (AI) was introduced to Argentina’s Chamber of Deputies. The Bill establishes a special legal action to protect individuals’ image rights against unauthorised content generated by artificial intelligence or similar technologies. It allows affected persons, their representatives, or heirs to file a claim digitally before any first-instance judge without fees, empowering judges to act within twenty-four hours. Judges may order the immediate blocking, removal, or de-indexing of disputed content and, upon confirming unauthorised use, require its permanent deletion from digital platforms. Non-compliance may result in daily fines proportional to the harm caused or temporary suspension of the platform’s operations. The Bill defines artificial intelligence as technology using machine learning or neural networks to generate new digital content and “ultrafalse” content as realistic AI-generated depictions of people made without their consent that harm their dignity. It applies broadly to online platforms that enable users to interact or share content.
