On 31 October 2025, the Guaranteeing Access and Innovation for National Artificial Intelligence Act (GAIN AI Act/HB 5885) was introduced to the United States House of Representatives. The Act proposes to amend the Export Control Reform Act of 2018 by requiring the issuing of an export license for covered advanced circuits or products to entities in countries of concern to be subject to the exporter providing a right of first refusal to domestic US persons. The Act would also include an exemption from certain licensing requirements provided the product is destined for a non-country of concern and remains under the control of a trusted US person. Countries of concern are listed in Country Group D:5 or E in Supplement No. 1 to part 740 of title 15, Code of Federal Regulations.
