Office of the United States Trade Representative initiated investigation into China’s implementation of the Phase One Agreement under Section 301 of Trade Act

On 24 October 2025, the Office of the United States Trade Representative (USTR) initiated a Section 301 investigation to determine whether China’s implementation of commitments under the Economic and Trade Agreement Between the Government of the United States of America and the Government of the People’s Republic of China (Phase One Agreement) denies United States rights or benefits or violates or is inconsistent with the Agreement. The USTR consulted advisory committees and the inter-agency Section 301 Committee and requested consultations with the Government of China under Section 303(a) of the Trade Act of 1974. The investigation examines commitments relating to intellectual property, technology transfer, and financial services, among others and will assess burdens or restrictions on United States commerce arising from non-implementation.
