Guidelines for User Age-verification and Responsible Dialogue Act (GUARD Act/ SB 3062) prohibiting AI companions that solicit or produce sexual content

On 28 October 2025, the Guidelines for User Age-verification and Responsible Dialogue Act (GUARD Act/ SB 3062) was introduced in the United States Senate. The Bill prohibits providers from designing, developing, or operating an AI chatbot that knowingly or recklessly risks soliciting or encouraging minors to engage in or describe sexually explicit behaviour or to create or share explicit images. It also prohibits designing, developing, or operating AI chatbots that encourage, promote, or coerce suicide, self-harm, or physical or sexual violence. Violations are subject to fines of up to USD100,000 per offence. Additionally, all AI chatbot providers must require users to create accounts before interacting with their systems.
