Republic of Korea: Fair Trade Commission ordered Baemin to amend merchant contract terms to address unfair practices

On 13 October 2025, the Fair Trade Commission ordered Baemin, a food delivery platform, to amend nine categories of unfair merchant contract terms. It requires Baemin to clarify and limit restaurant exposure distance restrictions with mandatory merchant notification, specifying payment settlement withholding reasons with extended seven-day objection periods and delayed interest payments for platform-caused delays. It also requires replacing public notices with individual 30-day notifications for disadvantageous terms changes, limiting liability exemptions to cases without operator intent or negligence, constraining the scope of arbitrary merchant obligations to named service areas, and prohibiting the imposition of core obligations through subsidiary policies or guidelines.
