California AI Transparency Act including authorisation requirements was signed by Governor of California

On 13 October 2025, the California Artificial Intelligence (AI) Transparency Act was signed by the Governor of California. The Act applies to AI providers with over 1 million monthly users, large online platforms with over 2 million monthly users, and capture device manufacturers in California. The Act requires AI providers, large online platforms, and capture device manufacturers to meet specific operational obligations before offering products or services in California. Covered providers must offer free AI detection tools and display system provenance data. The Act also provides that large online platforms must detect and disclose provenance data from 1 January 2027. It also provides that GenAI hosting platforms cannot make available systems lacking required disclosures. Capture devices sold from 1 January 2028 must include latent disclosures of device, manufacturer, and timestamp. Non-compliance carries civil penalties of USD 5,000 per day and legal costs. The Act takes effect on 2 August 2026, with platform rules from 1 January 2027 and capture device rules from 1 January 2028.
