Aligning Incentives for Leadership, Excellence, and Advancement in Development Act (AI LEAD Act/S.2937) including unilateral conduct regulation was introduced in Senate

On 29 September 2025, the Aligning Incentives for Leadership, Excellence, and Advancement in Development Act (AI LEAD Act/S.2937) was introduced in the Senate, stipulating that a deployer of an artificial intelligence system assumes developer liability where it makes a substantial modification to the system or engages in intentional misuse contrary to the intended use, and that misuse proximately causes harm. Intended use may be inferred from the targeted market and distribution when unspecified by the developer. The legislation prohibits attempts to transfer liability by contract where the deployer alters or misuses the system in ways not contemplated by the developer.
