Ofcom guidance on notification requirements for Video-sharing platforms (VSP)

On 10 March 2021, the Office of Communications (Ofcom) of the United Kingdom published a guidance to help service providers to assess if they fall within the jurisdiction of the Video-sharing platforms (VSP) Framework. Providers of VSP services must notify their operations to Ofcom. In particular, the following criteria are applied cumulatively to the final assessment: the service has among its principal purposes and essential functionalities the provisions of videos to the public; the service provides videos on a commercial basis via an electronic communications network; the service provider has control of the organization of videos but not over what videos are available to the final users.
