Presidential Decree No. 12622 establishing National Data Protection Agency as autonomous authority for protection of children online and powers for judicial blocking orders enters into force

On 18 September 2025, Presidential Decree No. 12622 entered into force, designating the National Data Protection Agency (ANPD) as the autonomous administrative authority responsible for enforcing the Law on the Protection of Children and Adolescents in Digital Environments (Law No. 15211). The decree gives the ANPD the authority to issue judicial blocking orders under the Law and defines its role in the implementation of related measures. It also assigns responsibilities to two other entities, the National Telecommunications Agency (Anatel), which is tasked with receiving and distributing orders to telecommunications service providers and other internet access agents, and the Brazilian Internet Steering Committee (CGI.br), which is responsible for orders concerning the resolution of domain names under “.br.” Both Anatel and CGI.br may determine the technical means for carrying out these measures.
