Australia: eSafety Commissioner adopted social media minimum age regulatory guidance under Online Safety Act

On 16 September 2025, the eSafety Commissioner adopted the social media minimum age regulatory guidance under the Online Safety Act 2021. The guidance applies to providers of age-restricted social media platforms and requires them to prevent users under 16 years old from holding accounts. Providers must detect and remove underage accounts, stop immediate re-registration, and provide clear information to users about account removal, data download, support services, and appeal options. The guidance is principles-based and requires continuous improvement of age assurance measures. Providers must comply with privacy obligations under the Privacy Act 1988 and maintain records to show adherence.
