European Commission closes consultation on guidelines on application of Article 101 of the Treaty to technology transfer agreements

On 23 October 2025, the European Commission closes the consultation on the draft revised Guidelines on the application of Article 101 of the Treaty on the Functioning of the European Union (TFEU) to technology transfer agreements. The guidelines outline the principles for assessing agreements under which a licensor permits a licensee to use specific technology rights for the production of goods or services. The guidelines aim to support companies in evaluating their agreements in line with EU competition law, and encourage the diffusion of technology, research, and development. The guidelines also explain the application of the revised Technology Transfer Block Exemption Regulation (TTBER).
