On 15 January 2025, the Ministry of Science and Information and Communication Technology (MSICT) announced the guideline on artificial intelligence impact assessment pursuant to Article 35 of the Framework Act on the Advancement of Artificial Intelligence and Creation of a Trust Foundation (AI Framework Act), requiring operators to conduct structured assessments of potential impacts on fundamental rights. The guideline obliges identification of affected subjects, mapping of rights implications, evaluation of harms and risks, and introduction of mitigation and recovery measures. For high-impact artificial intelligence systems, operators must make efforts to conduct assessments, which may be outsourced to qualified third parties. The guideline also ensures interoperability with the European Union (EU) guidance and directives on impact assessments.
