United States of America: Federal Trade Commission and Utah settled with Aylo and its affiliates for misleading claims regarding measures to address child sexual abuse material and nonconsensual sexual content

Description

Federal Trade Commission and Utah settled with Aylo and its affiliates for misleading claims regarding measures to address child sexual abuse material and nonconsensual sexual content

On 3 September 2025, the Federal Trade Commission (FTC) and the Utah Division of Consumer Protection adopted a proposed order, including USD 15 million penalty, to settle allegations against Aylo, operators of pornography-streaming sites, including Pornhub. The FTC and Utah alleged that Aylo deceived users by claiming to have zero tolerance for child sexual abuse material (CSAM) and nonconsensual material (NCM), while failing to block such content, review flagged videos, ban uploaders, or prevent re-uploads. Furthermore, Aylo was accused of engaging in unfair practices by distributing CSAM and NCM and failing to protect the privacy and security of personal data, such as dates of birth, Social Security numbers, and government-issued IDs, collected from individuals in its model program. As part of the settlement, Aylo is permanently prohibited from misrepresenting its practices related to preventing CSAM and NCM and is required to establish a program to prevent their distribution, implement a system to verify adult age and consent for all content, remove unverified pre-existing content, and post a notice about the order on its websites. Additionally, Aylo must implement a comprehensive privacy and information security program and pay a USD 5 million penalty to the state of Utah, as part of a USD 15 million penalty, with the remainder suspended.
