European Commission closes consultation on drafting guidelines on transparency requirements for certain AI systems under Article 50 AI Act

On 2 October 2025, the European Commission closes the consultation on the development of guidelines on transparency requirements for certain artificial intelligence (AI) systems under Article 50 AI Act. The guidelines will assist providers of AI systems to fulfil their transparency obligations under the AI Act, which requires providers to inform users if they are interacting with an AI system. The Act also requires them to mark AI-generated content and to inform those exposed to AI systems using biometric recognition about their operation. The consultation’s questionnaire includes five sections. The first section includes questions on the applicable exception in case the direct interaction with persons could be considered obvious, their use for law enforcement activities, and practical ways to design the systems for transparency. The second section includes questions on the same issues for AI-generated content and the criteria for the assessment of marking techniques. The third section covers questions on biometric categorisation systems, their use for law enforcement, and practical ways to inform the subject about their operation. The fourth section covers disclosure and law enforcement questions for deep fake content. It also includes questions relating to AI systems generating text to inform the public on matters of public interest, possible exceptions in case of human review or law enforcement, and best practices for informing the public. The fifth section covers a set of questions that relate to horizontal issues regarding Article 50 AI Act.
