Law 82/2021, which establishes procedures for monitoring content protected by copyright in the digital context, is adopted by the Portuguese Parliament. Firstly, the Law establishes the competence of Inspeção-Geral das Atividades Culturais (IGAC) to monitor the access to content protected by copyright and to determine the access restriction in the cases in which such content is unlawfully made available. Secondly, the Law details how rightsholders can submit a complaint to IGAC when their content is unlawfully made available. No later than 10 days after a complaint or the autonomous discovery of copyright violation, IGAC must notify the entity responsible for the infringement. Such entity must, within 48 hours, cease the unlawful access to protected content. Finally, the law raises the monetary value of the fines imposed on entities that are not compliant with such obligations. The Law will enter into full force on 29 January 2022.
