Bill amending Business and Commerce Code to include disclosure requirements for data brokers enters into force (SB 1343)

On 1 September 2025, the Bill amending the Texas Business and Commerce Code enters into force. The Bill requires data brokers operating in Texas with websites or mobile applications to display a notice stating their status as data brokers and informing consumers of their rights under Chapter 541 of the Texas Statutes. Chapter 541 of the Texas Statutes addresses unfair methods of competition and unfair or deceptive acts or practices by insurance companies. The Bill also mandates that registration statements include a direct link to consumer rights instructions, an outline of data categories processed, and disclosure of security breaches from the previous year, including the number of affected consumers. Additionally, data brokers handling children’s data must comply with enhanced transparency requirements.
