On 26 September 2025, the Act amending Arizona Revised Statutes to include internet pornography age verification enters into force. The Act requires commercial entities that knowingly and intentionally publish or distribute sexual material harmful to minors on internet websites, including social media platforms, to implement reasonable age verification to confirm that users accessing such material are at least eighteen years old. Verification must be carried out using a form of digital identification or a commercial age verification system that relies on government-issued identification or commercially reasonable transactional data, and no identifying information may be transmitted to any federal, state, or local government entity. Commercial entities or third parties conducting verification are prohibited from retaining identifying information after the process is complete or from transmitting it to government entities. The Act exempts bona fide news or public interest broadcasts, as well as internet service providers, search engines, and cloud service providers not responsible for creating the content. Parents or guardians of minors who access harmful material, and individuals whose identifying information was unlawfully retained or transmitted, may bring civil actions against violating entities.
