On 2 June 2025, the Decree No. 2025-484 entered into force, following its publication in the Official Journal of the French Republic (JORF) on 1 June 2025, pursuant to Article 29 of Law No. 2024-449 of 21 May 2024 on securing and regulating the digital space, specifying the tasks of the Regulatory Authority for Electronic Communications, Postal Services and Print Media Distribution (ARCEP) regarding the conditions for implementing essential requirements imposed on cloud computing service providers and defining the content of the technical reference offer for interoperability. The decree, applicable to providers within the meaning of Article L. 442-12 of the Commercial Code as amended by Law No. 2024-449, mandates ARCEP, after public consultation, to set rules and procedures for implementing essential requirements in accordance with Article 28(II) of the Law, including interoperability and portability specifications to facilitate, where possible, the interoperability of similar cloud services and the improvement of asset portability across different cloud computing services. In accordance with Article 29(V) of the Law, these rules and procedures must be finalised before 12 September 2025. The technical reference interoperability offer must include procedures for provider switching and porting to cloud services, methods and formats for switching and porting, any known technical restrictions or limitations, and the arrangements for making available the information listed in Article 28(II)(3) of the Law.
