On 23 July 2025, the Bill No. 3630/2025 was introduced to the Chamber of Deputies. The Bill proposes an amendment to Law No. 13.709 of 14 August 2018 (General Law on the Protection of Personal Data – LGPD) to permit the disclosure of personal data, including images and audio recordings, of individuals caught in the act of committing crimes within commercial establishments. The amendment introduces paragraph 8 to Article 7 of the LGPD, stipulating that the restriction on processing and dissemination of personal data does not apply in situations where the capture of such data occurs during the commission of a crime inside commercial premises, provided that the disclosure aims to identify the offender, alert the public, or support public authorities, does not expose uninvolved third parties, and respects the principles of necessity and proportionality whenever feasible. The bill enters into force on the date of its publication.
