Fair Trade Commission opened investigation into e-commerce platforms' compliance with amended Consumer Protection Act

On 29 July 2025, the Korea Fair Trade Commission (KFTC) conducted an on-site investigation at the Korea Fair Trade Mediation Agency to assess compliance with the amended Act on the Consumer Protection in Electronic Commerce. This review focused on evaluating the implementation of newly regulated deceptive interface design practices, known as “dark patterns”, outlined under Article 21-2(1)(1). The KFTC engaged 15 digital commerce operators and key industry associations to assess adherence to staggered pricing disclosure prohibitions following a six-month guidance period after the amendment's enforcement on 14 February 2025. The investigation aimed to gauge business readiness, clarify legal obligations, and identify any implementation challenges. The KFTC reaffirmed its policy to initiate ex officio investigations and apply corrective measures, including administrative fines, for confirmed violations post the 13 August 2025 compliance deadline.
