On 25 July 2025, Decree No. 12,564, setting procedures and technical requirements for biometric identity verification and digital contracting in payroll-deduction credit operations entered into force. The Decree establishes procedures and technical requirements for biometric verification of the worker’s identity, consent for the processing of biometric personal data, and the use of electronic and digital signatures in payroll deduction credit operations for contracting and registration purposes. It requires qualified consignee institutions and public operating agents to implement biometric verification mechanisms with proof of life and to ensure that consent is obtained freely, in an informed and unequivocal manner, in compliance with Law No. 13,709 on General Personal Data Protection Law. Consent must be recorded and electronically stored in an accessible and auditable format. The Decree permits digital formalisation of payroll credit operations through one of three methods including qualified electronic signature under ICP-Brasil, advanced electronic signature meeting the requirements of Law No. 14,063 on the use of the use of electronic and digital signatures, or a digital signature executed in a secure and authenticated environment with multifactor authentication and evidentiary safeguards.
