Data (Use and Access) Bill, including provision requiring inquiry into use of copyright works in development of Artificial Intelligence systems entered into force

On 20 August 2025, the Data (Use and Access) Act entered into force, including a provision requiring inquiry into use of copyright works in development of Artificial Intelligence (AI) systems. Under Section 136 of the Bill, the Secretary of State is mandated to prepare and publish a report on the use of copyright works in the development of AI systems within nine months of the Bill's passage. It applies to AI developers, including individuals and small and medium enterprises, and to copyright owners. The Bill requires the report to assess consultation options and alternatives, propose measures on metadata and web crawlers, and examine effects on data access and licensing. The report must also address disclosure duties, enforcement mechanisms, and overseas AI systems. The Secretary of State may publish multiple reports, informed by consultation responses.
