On 24 July 2025, the Financial Services Commission (FSC) opened a public consultation on the proposed amendments to the enforcement decree of the Financial Investment Services and Capital Markets Act (FSCMA) and its subordinate rules, until 2 September 2025. The amendments seek to bolster enforcement against unfair trading. The amendments apply to securities market operators, listed companies, and financial firms. The amendments authorise the Korea Exchange (KRX) to use pseudonymised personal data to shift from account-based to individual-focused surveillance, improving detection efficiency by 39%. Penalty surcharges for unfair trading, market disruption, and disclosure violations will be significantly increased, with added aggravated sanctions for financial sector employees and company executives.
