On 21 July 2025, the Artificial Intelligence (AI) Accountability and Personal Data Protection Act was introduced to the United States Senate. The Act seeks to establish a federal tort against the appropriation, collection, processing, sale, or other exploitation of individuals’ data without express, prior consent. The Act applies to entities, including those deploying generative AI systems, that misuse personal or inferred data, and provides individuals with a private right of action to claim damages, injunctive relief, and attorney’s fees. It bans predispute arbitration agreements and class action waivers, mandates explicit consent with clear third-party disclosure, and sets a federal minimum standard without pre-empting stronger state protections.
