European Union: Expert Group on B2B Data Sharing and Cloud Computing Contracts released final report on B2B data sharing and cloud computing contracts

On 2 April 2025, the Expert Group on B2B Data Sharing and Cloud Computing Contracts published its final report, presenting a set of recommended non-binding model contractual terms (MCTs) and voluntary standard contractual clauses (SCCs). These models aim to support contracts on data access, use, and processing, particularly in cloud computing and similar services. The MCTs and SCCs are designed to align with the requirements of the EU Data Act, focusing on business-to-business data sharing. While their adoption is optional, stakeholders should be aware that the obligations set out in the Data Act remain legally binding.
