National Commission on Informatics and Liberty released self-assessment tool for implementing an audience measurement solution exempt from consent

On 4 July 2025, the National Commission on Informatics and Liberty (CNIL) issued the self-assessment tool for implementing an audience measurement solution exempt from consent in accordance with Article 82 of the French Data Protection Act. The tool is designed to assess whether a solution meets the strict conditions for exemption from consent, not its full compliance with data protection law. Under the Act, consent is not required for trackers that are strictly necessary for providing a service. In the context of audience measurement, the trackers must be used solely to generate anonymous statistics for the exclusive benefit of the publisher and must not allow cross-site tracking or lead to reidentification. Providers are encouraged to share documentation with clients and offer configurations that meet the exemption criteria. Website and app publishers, meanwhile, remain responsible for verifying that any audience measurement solution they implement actually complies with the exemption conditions in practice.
