On 11 June 2025, the My Body, My Data Act of 2025 to protect the privacy of personal reproductive and sexual health information was introduced to the House of Representatives. The Act applies to regulated entities under the Federal Trade Commission’s jurisdiction, excluding certain health providers covered by the Health Insurance Portability and Accountability Act . It restricts the collection, use, and disclosure of such data to what is strictly necessary for requested services. It also grants individuals rights to access, correct, and delete their data without fees, and requires clear privacy policies. Retaliation against individuals exercising these rights is prohibited. Enforcement lies with the Federal Trade Commission, and individuals may bring private lawsuits with potential damages. The Act invalidates pre-dispute arbitration and joint-action waivers related to these claims, preserves First Amendment rights, does not override stronger federal or state laws, and includes a severability clause.
