The Act proposes establishing the Office of Information and Communications Technology and Services (OICTS) within the Bureau of Industry and Security of the Department of Commerce. The Act applies to firms involved in Information and Technology -related transactions, particularly those linked to jurisdictions or entities of concern such as China, Russia, Iran, and North Korea. It empowers the Secretary of Commerce to review, mitigate, or prohibit transactions that pose national security risks, mandates annual risk assessments by the Director of National Intelligence, and allows the issuance of rules targeting specific transaction classes. Enforcement measures include subpoena powers, civil and criminal penalties, and limited judicial review by the Circuit Court. The Act also includes conforming amendments to the Export Control Reform Act of 2018 and has been referred to the Senate Committee on Banking, Housing, and Urban Affairs.
