Notices Regime Code of Practice entered into force

On 6 June 2025, the Notices Regime Code of Practice entered into force. The Code applies to telecommunications operators and other entities that may be subject to data retention, technical capability, national security, or notification notices. It provides statutory guidance on the issuance, compliance, and review of such notices under Part 4 and sections 249 and 252 to 258B of Part 9 of the Investigatory Powers Act. It details the obligations they may impose, including retaining specific data or enabling technical capabilities, and outlining procedures, including consultation requirements and rights of review. The Code includes safeguards to ensure transparency, accountability, and the protection of individual and business rights.
