On 21 June 2025, the United States Senate Parliamentarian determined that the Budget reconciliation Bill, including a moratorium on the enforcement of state and local laws regulating Artificial Intelligence (AI), complies with the Byrd Rule and can remain in the budget reconciliation Bill. The Bill includes a 10-year federal moratorium on the enforcement of state and local laws regulating such technologies. Exceptions are made for laws that facilitate AI deployment, streamline administrative procedures, or impose neutral, cost-based requirements comparable to those applied to non-AI systems. The Byrd Rule restricts non-budgetary measures from being included in reconciliation Bills. Based on this determination, the moratorium can avoid the usual 60-vote requirement in the Senate and can proceed with a simple majority.
