United States of America: Senate Parliamentarian adopted determination on applicability of Byrd rule to the Budget reconciliation Bill including moratorium on the enforcement of state and local laws regulating Artificial Intelligence

On 21 June 2025, the United States Senate Parliamentarian determined that the Budget reconciliation Bill, including a moratorium on the enforcement of state and local laws regulating Artificial Intelligence (AI), complies with the Byrd Rule and can remain in the budget reconciliation Bill. The Bill includes a 10-year federal moratorium on the enforcement of state and local laws regulating such technologies. Exceptions are made for laws that facilitate AI deployment, streamline administrative procedures, or impose neutral, cost-based requirements comparable to those applied to non-AI systems. The Byrd Rule restricts non-budgetary measures from being included in reconciliation Bills. Based on this determination, the moratorium can avoid the usual 60-vote requirement in the Senate and can proceed with a simple majority.
