Brazil: National Data Protection Authority released guidance on neurotechnologies and data protection

On 9 June 2025, the Brazilian National Data Protection Authority (ANPD) released the fourth issue of its technological radar series, focusing on neurotechnologies and their implications for personal data protection under Brazil's General Data Protection Law (LGPD). The guidance examines concepts such as neural data and classifications of neurotechnologies, exploring their applications and highlighting ethical and legal challenges, including data privacy risks and the potential classification of neural data as sensitive personal data. It also discusses the need for robust governance frameworks, explores future trends such as artificial intelligence integration with neurotechnologies and consumer neurodevices, and emphasises compliance with LGPD principles such as purpose limitation, transparency, and security.
