Body of European Regulators for Electronic Communications opened consultation on guidelines on access to in-building infrastructure according to Article 11(6) of the Gigabit Infrastructure Act

On 5 June 2025, the Body of European Regulators for Electronic Communications (BEREC) opened consultation on the guidelines on access to in-building infrastructure according to Article 11(6) of the Gigabit Infrastructure Act, until 11 July 2025. The guidelines recommend that the utilisation of in-building physical infrastructure should remain free of charge. If the infrastructure is owned by an electronic communication network (ECN) operator, fair and reasonable prices should not deplete a reasonable first mover advantage. BEREC considers it preferable that, when available, access to the fibre itself is considered first, although this may not always be suitable. The guidelines describe additional terms and conditions, such as reasonable time limits, to consider during negotiation for sharing in-building physical infrastructure. Regarding criteria for dispute settlement, BEREC notes a strong willingness of most National Regulatory Authorities (NRAs) and stakeholders to focus on speed and transparency.
