On 5 May 2025, the Personal Data Protection Bill (S-0644/2025) was introduced to the Argentine Senate. The Bill would establish rules on cross-border data transfers, setting out the conditions under which personal data could be transferred to foreign jurisdictions or international organisations. Transfers would be permitted where the receiving country or body ensures an adequate level of protection, as determined by the Personal Data Protection Agency. In the absence of such a decision, transfers could proceed if appropriate safeguards are provided, such as standard contractual clauses, binding corporate rules, or approved codes of conduct. The Bill would also provide for specific derogations, including the data subject’s explicit consent or where the transfer is necessary for legal claims, contractual performance, or the protection of vital interests.
