Information Commissioner adopted guide on using and disclosing genetic information

On 9 May 2025, the Australian Information Commissioner adopted guidance on the use and disclosure of genetic information under the Privacy Act 1988. The guidelines aim to clarify when health service providers may use or disclose a patient’s genetic information without consent. The guidelines apply to providers who, in the course of delivering care, identify serious inheritable risks to a patient’s genetic relatives. The update allows disclosure without consent if it is necessary to lessen or prevent a serious threat to a relative’s life, health, or safety and if the action aligns with s 95AA guidelines. Providers may also collect and use relatives’ contact details without consent where it is unreasonable or impracticable to obtain it. Reasonable steps must be taken to ensure the accuracy of both genetic and contact information prior to use.
