Department for Science, Innovation and Technology opened consultation on draft regulations under Product Security and Telecommunications Infrastructure Act 2022

On 7 May 2025, the Department for Science, Innovation and Technology opened a technical consultation on draft regulations to commence sections 61 to 64 of the Product Security and Telecommunications Infrastructure Act 2022. The consultation remains open until 2 July 2025. It concerns secondary legislation implementing the Renewals Provisions, which amend Part 2 of the Landlord and Tenant Act 1954 in England and Wales and the Business Tenancies (Northern Ireland) Order 1996 in Northern Ireland. These amendments apply to tenancies primarily intended to confer Code rights on telecommunications operators in relation to telecommunications infrastructure. The consultation seeks views on whether the saving and transitional provisions in the draft regulations effectively ensure a clear transition for “live tenancies” and address the risk of retrospective rent adjustments (the “Backdating Issue”). It does not invite comment on the underlying policy decisions established by the 2022 Act.
