On 28 April 2025, the Bill on Artificial Intelligence Consumer Protections (SB25-318) was introduced to the Colorado Senate, introducing revised regulatory obligations for developers and deployers of high-risk AI systems. The Bill assigns exclusive enforcement authority to the Colorado Attorney General, who is empowered to investigate and enforce compliance beginning 1 January 2027. It also establishes an affirmative defence framework, allowing developers and deployers to avoid enforcement if they demonstrate prompt remediation of violations and adherence to recognised risk management practices. In cases where information is withheld, the Bill requires disclosure of the legal basis and non-exempt content to both affected consumers and the Attorney General. These provisions define the scope and timing of the Attorney General’s oversight while structuring compliance incentives for AI system operators.
