United States of America: Florida Attorney General initiated lawsuit against Snap over its alleged violations of Florida's HB 3 and Deceptive and Unfair Trade Practices Act (FDUTPA)

Description

Florida Attorney General initiated lawsuit against Snap over its alleged violations of Florida's HB 3 and Deceptive and Unfair Trade Practices Act (FDUTPA)

On 22 April 2025, the Florida Attorney General initiated legal proceedings against Snap, the operator of Snapchat, for alleged violations of Florida's HB 3 and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). The lawsuit asserts that Snapchat employs four of the five addictive design features identified in HB 3, including infinite scrolling, push notifications, personal interactive metrics such as SnapStreaks, and auto-play videos, which promote behavioural addiction and compulsive use. Despite acknowledging its obligation under HB 3, Snap is accused of openly defying the law by marketing Snapchat as safe for users as young as 13, while failing to address risks such as exposure to pornography, drug access, profanity, sexual content, and interactions with predators or drug dealers. The lawsuit further alleges that Snapchat's age ratings and safety claims are deceptive, misleading parents and consumers about the platform's dangers.
