Communications Regulatory Authority adopted Regulation for the Protection of Minors in the Digital Environment (Resolution no. 96/25/CONS) including age verification requirement

On 18 April 2025, the Italian Communications Regulatory Authority (AGCOM) adopted Resolution 96/25/CONS, which outlined requirements for the verification of the age of online users. This was in accordance with the Law No. 159/2023. The Resolution stipulates that video-sharing platforms and websites offering content in Italy must implement age verification systems, to be developed following consultation with relevant stakeholders and review by the European Commission. The Resolution stipulates the utilisation of certified third parties for the purpose of age verification, encompassing a two-step identification and authentication process. The systems are required to ensure data minimisation and user anonymity, with platforms given a period of 6 months from the publication of the resolution to comply. The rules are aligned with principles of proportionality, accessibility, and non-discrimination, with potential adjustments based on future European Union (EU) guidelines.
