European Union: French Council of State referred a request for a preliminary ruling to the Court of Justice of the European Union concerning Amazon case against France's minimum delivery pricing for online book sales (Case C‑366/24)

Description

French Council of State referred a request for a preliminary ruling to the Court of Justice of the European Union concerning Amazon case against France's minimum delivery pricing for online book sales (Case C‑366/24)

On 21 May 2024, the French Council of State referred a request for a preliminary ruling to the Court of Justice of the European Union concerning Amazon. The referral seeks clarification on the interpretation of Articles 1(4) and 16 of Directive 2006/123/EC on services in the internal market in relation to national measures aimed at promoting cultural diversity. Specifically, the Court is asked to determine whether such measures fall outside the scope of the Directive or may justify restrictions on service providers established in another Member State. The French Council of State also asks whether compatibility with the Directive precludes parallel assessment under EU primary law, and whether mandatory minimum delivery charges for books should be assessed under the rules on the free movement of goods or the freedom to provide services.
