Competition Council order on mandatory filing thresholds enters into force

On 1 June 2023, the Competition Council in Morocco amended the country's merger control regulations by issuing an order adjusting the mandatory filing thresholds for mergers. The updated rules require entities to notify and seek approval from the Council if any of the following conditions are met: (i) the combined worldwide turnover of the parties exceeds MAD 1.2 billion (USD 120 million), with at least one party's turnover in Morocco over MAD 50 million (USD 5 million); (ii) the cumulative turnover in Morocco surpasses MAD 400 million (USD 40 million), with at least two parties individually achieving a turnover greater than MAD 50 million (USD 5 million) in Morocco; or (iii) the entities' combined market share in Morocco exceeds 40%.
