On 4 April 2025, the Competition and Markets Authority (CMA) published updated consumer protection enforcement guidance pursuant to the Digital Markets, Competition and Consumers Act 2024 (DMCC Act). The guidance sets out the CMA’s responsibilities as the United Kingdom’s civil enforcement authority for consumer protection law and outlines the enforcement powers available to it, including civil court-based powers, investigatory powers, and, in certain cases, criminal enforcement. It describes procedures for initiating investigations, obtaining information, and pursuing outcomes such as undertakings or court orders. The guidance also outlines the CMA’s cooperation with domestic regulators and international partners, including its participation in the Consumer Protection Cooperation (CPC) network. This document replaces the previous version published in August 2016 and reflects current legal frameworks and procedural arrangements under the DMCC Act.
