On 18 December 2008, the President signed the Electronic Transactions Act, 2008 (Act 772) into law. The Act establishes liability protections for intermediaries facilitating the transmission, routing, storage, or access to electronic records, provided they do not initiate, select recipients, or alter content. The Act clarifies that intermediaries are not generally required to monitor electronic records for potential criminal offences or civil liability. It allows individuals, however, to notify publishers about potentially illegal or unlawful and request its removal. Intermediaries can be held liable for wrongful takedowns.
