Germany: Federal Ministry for Economic Affairs and Climate Protection and Federal Ministry for Digital and Transport Affairs opened consultation on Act for implementation of Regulation (EU) 2023/2854 on fair access to and use of data

On 7 February 2025, the Federal Ministry for Economic Affairs and Climate Protection and the Federal Ministry for Digital and Transport Affairs opened a consultation on the Act for implementation of Regulation (EU) 2023/2854 on fair access to and use of data (Data Act), until 14 March 2025. The Act applies to businesses and public authorities handling data access and sharing under the Data Act. The Act designates the Federal Network Agency as the central supervisory authority, outlining its enforcement and monitoring responsibilities. It also highlights cooperation with the Federal Commissioner for Data Protection and Freedom of Information, and provisions for private dispute resolution and sanctions.
