Competition Authority of Kenya opened consultation on draft Competition (Amendment) Bill, 2024 including merger control regulation

On 27 May 2024, the Competition Authority of Kenya (CAK) opened a consultation on the draft Competition (Amendment) Bill, 2024, until 14 June 2024. The draft Bill amends Section 43 of the Competition Act to allow the Competition Authority of Kenya (CAK) to invite public input on proposed mergers within 14 days of notification. Additionally, Section 41 is amended to include mergers involving privatised institutions, broadening the scope of merger control to cover a wider range of transactions and prevent market consolidation.
